What the FTC bans, what New York now requires, and what Meta does on its own. Plain English, with sources.
Yes, AI UGC ads are legal in the US. The rules are about honesty: no fake testimonials, no AI presenter posing as a real customer who got results, and claims you can back up. Since June 9, 2026, New York also requires a conspicuous disclosure when whoever makes an ad knows it shows a synthetic performer.
General information for US advertisers, written by an AI ad agency, not a law firm. It isn't legal advice. Check the rules for where your ads run, and ask your own counsel about your claims.
The FTC's rule on consumer reviews and testimonials (16 CFR Part 465) took effect on October 21, 2024. It bans fake reviews and testimonials, including ones that misrepresent who said them or whether they had real experience with the product.
The FTC's Endorsement Guides (16 CFR Part 255) set out how endorsements and testimonials can be used. Three parts matter most for AI UGC:
New York General Business Law section 396-b took effect on June 9, 2026. Anyone who produces or creates an ad for a commercial purpose has to conspicuously disclose a synthetic performer in it, when they know one is there. A synthetic performer is a digitally created asset, made with generative AI or a software algorithm, meant to give the impression of a human performer who isn't recognizable as any real person.
Meta has no general rule that commercial ads must disclose AI. Its AI disclosure requirement covers social issue, election and political ads. Separately, Meta may read the AI markers that generation tools embed and add an "AI info" label on its own.
A health, weight or results claim needs the same support whether a person or an AI presenter says it. The FTC judges what an ad implies, not just the literal words. For supplements and skincare, that's usually where the real risk sits.

Yes. US law doesn't ban AI presenters in ads. What it bans is deception: fake testimonials, a presenter posing as a real customer who got results, and claims you can't back up. New York also requires a disclosure when whoever makes the ad knows it shows a synthetic performer.
Not as a real customer. The FTC's rule on reviews and testimonials has no blanket ban on AI avatars, but a testimonial has to reflect a real person's honest experience. An AI presenter can explain the product, demonstrate it or read out real customer reviews.
In New York, yes, when whoever makes the ad knows it shows a synthetic performer. Meta has no general disclosure rule for commercial ads (its AI disclosure rule covers social issue, election and political ads), and it may label AI content it detects on its own.
Yes. The FTC says advertising agencies are not immune under its reviews and testimonials rule, and New York's law applies to whoever produces or creates the ad.
Yes. A health or results claim needs the same evidence whether a person or an AI presenter says it.
